Abstract

With repeal of the extraterritorial income exclusion expected in 2004, many U.S. companies selling abroad must rethink tax strategies related to export profit. Many firms with net operating loss (NOL) carryforwards, foreign tax credit (FTC) carryforwards, and interest-charge domestic international sales corporations (ICDs) can reduce marginal tax rates (MTRs) below rates otherwise applying to domestic sales. This article provides several case examples illustrating how U.S. exporters can minimize the MTR applicable to export profit. MTRs often depend on the period over which the company expects to absorb its NOL or FTC carryforward, the firm’s discount rate, and, in the case of ICDs, the prevailing T-bill rate. Assuming a 34% corporate tax rate, exporters with NOL (FTC) carryforwards can reduce the MTR on export profit to zero (17%) in some cases. Also, over the range of variables this article examines, the ICD reduces the MTR on export profit to between 34 and 21%. The cases illustrate how NOL and FTC carryforwards and ICDs affect exporters’ MTRs and provide educators with useful tools for discussing the tax aspects of exporting.

Abstract

In a decentralized supply chain with one supplier and one retailer, a properly designed contract can lead to supply chain coordination. In this chapter, we model the selection of an appropriate coordinating contract from a menu of contracts including wholesale price, buyback, and markdown money, while allowing both the supplier and the retailer to assume the roles of Stackelberg leader and/or supply chain captain. This work extends previous literature that assumes that the supplier is both the Stackelberg leader and the supply chain captain. In our models, either agent can make stocking and pricing decisions. Our findings suggest that the feasibility of a coordinating contract depends on the addition of Pareto-improving, profit-sharing conditions that motivate agents to take part in the contract. Further, the selection of an optimal contract is based not only on which agent holds the overstock liquidation advantage, but also on the decision structure of the supply chain. For instance, when the supplier is the Stackelberg leader and the retailer is the supply chain captain, as well as holds the inventory liquidation advantage, and controls the stocking level, then a wholesale price contract can coordinate the supply chain under the proposed Pareto-improving profit sharing, termed Pareto-improving coordination. Additional results and managerial implications are presented in the chapter.

Abstract

We study the impact of tax and minimum wage reforms on the incidence of informality. To gauge the incidence of informality, we use measures of the extent of tax evasion, the extent of minimum wage noncompliance, and the size of the informal workforce. Our approach allows us to examine (i) the distinction between determinants of firm-level reported wage distribution and actual wage distribution, (ii) the complementarity of tax and minimum wage enforcement, (iii) the impact that a minimum wage reform has on tax and minimum wage compliance, and (iv) the impact that a tax policy reform has on tax and minimum wage compliance. We conclude with the design of optimal minimum wage and tax policies (even in the complete absence of minimum wage enforcement). We do so based on two objectives derived from popular concerns associated with an unchecked expansion of informality: tax revenue maximization, and poverty alleviation among workers.

Firms and individuals budget or account for dollars, not standardized dollars, squared dollars, squared deviations from mean dollars, or percentage of squared deviations from mean dollars – my checking account reports my balance in dollars. In contrast, we have all seen a model dismissed because it “only explained 9% of the variance.” However, the Brogden–Cronbach–Gleser (BCG) model clearly shows that rxy (or

 ) is linearly related to a model's dollar utility to the firm, not  or  . In other words, when rxy (or  ) doubles for a strategic management model designed to predict profit (Y$), then the predicted dollar value added to the firm doubles (e.g., when rxy=0.30 and  , the addition of X2 to the model has increased expected dollar value added to the firm by a factor of 2). Hence, a model that explains only 9% of the variance in Y$ in fact explains 30% of the dollar utility available to be explained in Y$, even though tests of the null hypothesis H0: rxy=0 and  will yield mathematically identical outcomes to tests of  and  . Not surprisingly, I rarely see the BCG model cited in the scholarly management literature, and never see it cited by strategic management scholars. So, I will first demonstrate how the BCG model was originally developed to estimate the value of personnel selection systems, though it also characterizes how the dollar impact of any organizational intervention can be estimated, be it strategic, entrepreneurial, HR-related, etc. I will then make some minor adjustments to show how the model can be applied to more macro, strategic research arenas as well as some of the more interesting implications that are seldom fully appreciated in the current management literature. I will conclude this section with an example of how the BCG model might be applied to a recent strategic management study published in a recent issue of the Academy of Management Journal.

The Supreme Court’s decision in Federal Trade Commission v. Actavis, Inc. is a challenge to conventional antitrust analysis. Conventional civil antitrust cases are decided by a preponderance of the evidence. This means that conduct challenged under the rule of reason is only condemned if the conduct resulted in more competitive harm in the actual world than a world without the alleged violation. Under conventional analysis, the intent of the parties also plays only a supporting role in determining whether the conduct was anticompetitive. A holder of a valid patent has a right to exclude others practicing the patented technology. And, the patent holder is not assumed to have market power because it expended resources in maintaining exclusionary rights. Actavis creates doubts about these propositions in circumstances beyond the “reverse” payment settlement of a patent suit that may have delayed an alleged infringer market entry. This chapter explores whether applying Actavis logic to antitrust litigation can result in condemnation of practices where there is little chance of an anticompetitive effect, where the patent holder likely has a valid and infringed patent, where there is little reason to believe that the patent holder has market power, and where only one party, or no parties, to an agreement have an anticompetitive intent. This chapter also investigates whether Actavis creates new problems with standing analysis, damages calculations, and the balancing of efficiencies against anticompetitive effects. Nevertheless, the lower courts have begun to extend the logic of Actavis. This is apparent in the condemnation of no-Authorized-generic settlements.

Abstract

Theories of the business cycle can be classified into two main groups, exogenous and endogenous, according to the way they explain economic fluctuations – either as responses of the economy to factors that are external (exogenous shocks) or as upturns and downturns of the economic system internally generated (by endogenous factors). In endogenous theories, investment is generally a key variable to explain the dynamic status of the economy. This essay examines the role of investment in endogenous theories. Two contrasting views on how changes in investment and profitability push the economy towards expansion or contraction are represented by the insights of Kalecki, Keynes, Matthews and Minsky versus those of Marx and Mitchell. Hyman Minsky claimed that investment ‘calls the tune’ to indicate that investment is the only variable not determined by other variables, so that future profits, investment and the dynamic status of the economy are determined by current investment and investment in the near past. However, this hypothesis does not appear to be supported by available empirical data for 251 quarters of the US economy. Statistical evidence rather supports the hypothesis of causality in the direction of profits determining investment and, in this way, leading the economy towards boom or bust.
