Abstract

The study analyses production worker hiring standards based on time series personnel records drawn from matched plants in the U.S., U.K., Italy, the Netherlands and Belgium. Our hypothesis is that labor market regulation pushes upwards hiring standards for production workers. Labor market regulation is measured both by an employment protection index, and by workforce average tenure as a proxy for insider power. We find that the average tenure variable gives more robust results than the index. Its effect is to increase education standards, but to reduce starting age standards. The expected positive effect of employment protection on hiring standards is found in simple regressions, but is not generally supported by the multivariate analysis once other influences are held constant. However, union density is found to increase hiring standards, and might take over the effect of employment protection as an indicator of overall regulatory pressure. We also find a strong substitutability between recruits’ prior experience and education. This substitutability indicates the power of education to widen job opportunities for inexperienced workers.

Abstract

The issue of employment status lies at the heart of much conflict in the gig economy, with many gig economy workers effectively excluded from statutory employment protection because of it. Establishing employment status continues to be the gateway to accessing most UK statutory employment rights, a fact which makes the exclusion of casual workers from much statutory protection seem arbitrary and unjust. Employment status has been historically determined by common law conceptions of the contract of employment. This creates particular difficulties for casual workers, who have typically had to prove a requirement to perform personal service and to show that the contract was based on mutual obligations in order to be recognised as employees. The advent of the gig economy has seen the concept of employment status evolve as courts and legislators have struggled to adapt to a more flexible labour market. Likewise, gig economy employers have gone to considerable lengths to try to circumvent the legal protections available to their workers. This chapter will examine the evolving role of common law doctrine in defining employment status and the emergence of the category of ‘worker’ as an definition of employment status for those who work in the gig economy. It will analyse prominent cases involving gig economy employers (such as Uber BV v Aslam) and explore how these cases have re-defined contractual doctrine. Finally, the chapter will analyse the Taylor Review (2017) and examine the viability of a conceptual uncoupling of statutory employment protection from contractual doctrine.

Abstract

Our research investigates how state-sponsored social protection is associated with undertaking the initial steps to start businesses in knowledge-intensive sectors. We define social protection as policies to protect individuals against economic risk. Although research generally shows a negative link between coordinated market economies and business creation, we highlight conditions when social protection may actually have positive consequences on entrepreneurial action. Specifically, these policies can encourage individuals to develop specific skills, which can be used by those who start businesses to pursue opportunities in knowledge-intensive sectors. Findings from a cross-national sample of individuals starting businesses in 16 advanced industrialized countries are consistent with this claim. We also find that educational attainment moderates this positive direct relationship. Our study is one of the first that provides new explanations for how welfare states can actually promote certain types of entrepreneurial action in highly coordinated economies by orienting their economic activity toward a system of highly skilled and productive labor.

Abstract

An adverse health event can affect women’s work capacity as they need time to recover. The institutional framework in the Netherlands provides employment protection during the first two years after the diagnosis. In this study, we have assessed the extent to which women’s employment is affected in the short- and long term by an adverse health event. We have used administrative Dutch data which follow women aged 25 to 55 years for four years after a medical diagnosis. We found that diagnosed women start leaving employment during the protection period and four years later they were about one percentage point less likely to be employed. Women in permanent employment did not reduce their employment during the protection period and reduced their employment with less than 0.5 percentage points thereafter. Furthermore, we found minor adjustments in the working hours in the short term and no adjustments in the long term. Lastly, we found that for wages, and not for employment and hours, adjustments could be related to the severity of the health condition: women diagnosed with temporary health conditions experienced a short-term wage penalty of about 0.5–1.7 percent and those diagnosed with chronic and incapacitating conditions experienced a long-term wage penalty of about 0.5 percent, while women diagnosed with some chronic and nonincapacitating conditions, such as respiratory conditions, experienced no wage changes in the short or long term.

Abstract

Purpose – The purpose of this chapter is to shed new light on the effects of labor market institutions and the economic conditions on self-employment composition that may help the development of a comprehensive strategy to promote job creation and sustained economic growth in the post-2009 era.

Methodology/approach – Using microdata from the European Community Household Panel for the EU-15, we analyze the effects of employment protection legislation, start-up incentives, and economic conditions on transitions from unemployment and paid employment to self-employment, as well as on self-employment survival, with a special focus on the differentiated effect of these variables on different types of self-employment.

Findings – The empirical results suggest that the coexistence of recession periods, start-up incentives, and strict employment protection may be distorting the occupational choice against true entrepreneurs and favor less entrepreneurial forms of self-employment – such as last resort or dependent. Therefore, the differentiated effect of the regulatory environment and the economic conditions over different forms of self-employment – that contribute to job creation, growth and innovation processes in a different manner – may help explaining the different incidence in terms of employment of the economic crisis across countries.

Social implications – During deep recessions, stringent labor regulations might prompt that public expenditure designed to move the unemployed back to employment favors atypical forms of employment outside the scope of labor laws, deteriorating employment rights, and the social protection of workers. As a consequence, the interaction of different LMI and the business cycle should be considered when defining the regulatory environment.

In the platform era the informal employment in China is tremendously huge in quantities. This paper sets out the changes of traditional regulatory rules status, the new web of rules and, with a particular focus on, the impacts of main actors’ interacts, from an industrial relations ‘web of rule’ perspective. The subjects involved in this paper are multiple, including labour law, collective labour relations institution, enterprise human resources management, CSRs and NGOs in production supply chains. It argues the inappropriate impacts on the perseverance of right and interests of workers are consequences of the current national labour law and collective labour relations institutions. It witnesses the emerging innovative methods, employment relations system in a self-dependent economic transaction, the rule of production supply chain in a multi-stake-holder context and the new intervening method of NGOs. It is in scrutiny of the commence of such a transformation in China, nevertheless, transforming from the authoritarian regime to a more fair market establishing via the intervention of multiple social forces, and consequently the transformation from informal employments to formal ones in a comprehensively complex domestic and global context.

Abstract

The main purpose of the chapter is to explain the impact of labour market security on migration-related decisions, especially in terms of push-pull factors theory. There are different ways to understand work-related security; the chapter discusses the importance of job security, employment security and income security from labour migration perspective. The article presents the existing body of literature on theoretical concepts as well as on some methodological facets of the measurements of the level of particular aspects of work-related security. Special attention is paid to labour migrants in terms of their working conditions in both sending and receiving countries. An overview of previous migration studies proves that the issue of migrants’ labour market security was not the subject of any in-depth analyses. There are, however, many examples of research showing that, under certain conditions, migration decisions are influenced by, among others, the generosity of a welfare state, stability of job and the desire to achieve the so-called normal life. In the case of migrants from third countries (e.g. from Ukraine), income security is of particular importance alongside remuneration.

Abstract

The chapter elaborates a critical theoretical narrative about the political economy of European capitalism. It illustrates how precariousness has been exacerbated by the impact of the global financial crisis and the emergence of a new system of European governance. Theoretical accounts in the sociology of work and labor studies have demonstrated the complexity of the outcomes and widely discussed the role of national labor market institutions and employment policies and practices, political ideology, and cultural frameworks impinging upon precarious work as a multidimensional concept. The chapter’s core concern is to illustrate how shifts in power resources, and particularly the weakening and deinstitutionalization of organized labor relative to capital, has acted as a central social condition that has brought about precariousness during the years leading up to and following the 2007–2008 crisis. In so doing, the chapter aims to overcome the existing theoretical accounts of precariousness which have often been limited by one or another variant of “methodological nationalism,” thereby exploring the transnational apparatuses that are emerging across national economies to date, and which impinge upon the structures and experiences that workers exhibit in an age of growing marketization.

Abstract

In this chapter, we aim to illustrate some of the forms taken by informal employment in the global south and how these can best be understood by adopting a wider analytical lens than has been applied in much of the precarious employment literature. We draw on the findings of a recent study of the working conditions of urban informal workers from 10 cities in the global south. The study consisted of focus groups (15 in each city) conducted through the framework of a participatory informal economy appraisal as well as a survey of 1,957 home-based workers, street vendors, and waste pickers. Our findings illustrate a number of ways in which these three groups of informal workers are embedded within the formal economy. While they are not engaged in wage employment, they play subordinate roles to both formal sector firms within global production networks and unequal production relations and to the state through, inter alia, constrained access to public spaces and regulation. In order to interpret these findings, we apply Agarwala’s (2009) “relational” lens to demonstrate how risks and costs are transferred to workers who constitute the “real economy” in much of the global south. Given the often disguised connections between informal employment and the formal economy, this approach also provides a bridge to understanding precarious working conditions and the effects of globalization outside of the industrialized north.
