Abstract

This chapter proposes a research agenda for the study of large law firm culture and explains how the research would contribute to both legal ethics and organizational theory. It focuses on two sets of questions that are uniquely suited to investigation in large law firms. First: what is the significance of organizational culture, relative to that of professional networks and subgroups? To what extent does organizational membership shape lawyers’ understandings about “how things are done”? Second: how is organizational culture sustained? What are the mechanisms of cultural integration in volatile, multioffice firms? The chapter draws on a pilot study of law firm culture in one 500-lawyer firm.

Purpose: At a conference inspired by Hans Christian Andersen, this chapter makes the case for his shadowy American contemporary, Edgar Allan Poe.

Methodology: Employing a comparative literary analysis, it contends that consumer culture theory (CCT) can learn more from Poe’s quothful raven than Andersen’s ugly duckling.

Findings: Principally that Poe’s Ps of Perversity, Pugnacity, and Poetry are particularly pertinent to an adolescent, self-harm-prone subdiscipline that’s struggling to find itself and make its way in the world.

Originality: Poe and Andersen’s names rarely appear in the same sentence. They do now.

Drawing on the idea of bio-power from wider social theory, this paper will demonstrate how life itself (bios) is now a crucial resource enlisted by capitalism. To explain this, the concept of biocracy is introduced to demonstrate how the informal subcultures, social intelligence and personal attributes of workers are currently being put to work. All that Fordism once feared is now the medium of a new form of exploitation. But as life itself is colonized in ever more expansive ways, resistance appears once again. A new political landscape has crystallized transforming the old tension between capital and labour into one between capital and life. Its manifesto is defined not by the demand for more, less or fairer work, but the end of work.

Abstract

Is the aim of the university to prepare citizens to contribute to civic and social life as well as to travel flexibly and successfully through a rapidly changing work world? Or is the purpose of higher education more narrowly to advance students’ individual economic interests as they understand them? Should we think of students as citizens or consumers? Many analysts argue that, in recent years, the notion that higher education should serve to advance students’ individual economic position has increasingly taken prominence over broader notions of the purpose of American higher education. In this paper, we examine whether and to what extent a shift from considering students-as-citizens to students-as-consumers has occurred in US higher education. We provide a longitudinal analysis of two separate and theoretically distinct discourse communities (Berg, 2003): higher education trustees and leaders of and advocates for liberal arts education. Our data suggest a highly unsettled field in which commercial discourse as measured by the student-as-consumer code has surely entered the US higher education lexicon, but this code is not uncontested and the more traditional citizenship code remains significant and viable.
