Abstract

The chapter is based on studies that explored the consideration of motherhood as a mitigating factor when sentencing women to imprisonment in criminal courts in England and Wales. Drawing upon two studies I conducted, it examines the way in which motherhood has been constructed by the courts and the difficulties in centring women's experiences within sentencing. It demonstrates how only by moving to a focus on children's rights has it been possible to ensure sentencers consider the implications of a defendant's motherhood.

The chapter outlines the parameters within which a sentencer can consider motherhood and explores some of the findings from the qualitative research I undertook with Crown Court judges, as part of a larger study in which I also interviewed children whose mother was at the time of interview in prison and the adults providing care to the children in her absence. The studies found that there was inconsistent understanding of a sentencer's duty to consider the impact of any sentence upon dependent children, coupled with a lack of understanding of the consequences of maternal imprisonment for a child. The ways in which this contravenes the Human Rights Act, 1998 and the United Nations Convention on the Rights of the Child 1989 are identified.

The resources which have been developed for sentencing professionals as a consequence of that work are discussed before considering the lack of concern for women's motherhood when imprisoning women on remand or recall. The chapter concludes with a call for motherhood, and not just children's rights, to be centred in sentencing decisions.

Abstract

Purpose

We explore: (1) the effects of work unit pressure on employees’ satisfaction with work–family balance (S-WFB); (2) the effects of individual-level job and family pressures on S-WFB; and (3) the extent to which schedule control moderates the negative influences of work unit pressure and other demands on employee S-WFB – among employees in a large healthcare system.

Methodology

The data come from employee responses to the baseline survey (n = 3,950) administered in September 2012, and from administrative unit-level data (445 units) showing the extent to which units were “on-budget” (within 5 percent), “over-budget,” or “under-budget.”

Findings

Practices associated with cost containment in a healthcare system of 10,000 employees in the United States appear to have a negative impact on employee S-WFB. Working in a unit that is “under-budget” is negatively associated with individual S-WFB. Employees with high job demands, longer hours, responsibilities for children and/or adults, also reported lower S-WFB than employees without these characteristics.

Research limitations/implications

Research is limited by lack of measures specific to healthcare workers, the use of baseline data only, and sample size for some of the analyses.

Social implications

Schedule control makes a difference even under high work pressure. The lack of interactions among variables that typically moderate relationships between work pressures and S-WFB suggests the need for more support for healthcare workers under the strain of cost containment.

Originality/value of the chapter

We include an objective indicator of unit-level job pressures on individual employees, thus identifying specific ways that work stress affects S-WFB.

The subject of part‐time work is one which has become increasingly important in industrialised economies where it accounts for a substantial and growing proportion of total employment. It is estimated that in 1970, average annual hours worked per employee amounted to only 60% of those for 1870. Two major factors are attributed to explaining the underlying trend towards a reduction in working time: (a) the increase in the number of voluntary part‐time employees and (b) the decrease in average annual number of days worked per employee (Kok and de Neubourg, 1986). The authors noted that the growth rate of part‐time employment in many countries was greater than the corresponding rate of growth in full‐time employment.

The US fertility transition in the nineteenth century is unusual. Not only did it start from a very high fertility level and very early in the nation’s development, but it also took place long before the nation’s mortality transition, industrialization, and urbanization. This paper assembles new county-level, household-level, and individual-level data, including new complete-count IPUMS microdata databases of the 1830–1880 censuses, to evaluate different theories for the nineteenth-century American fertility transition. We construct cross-sectional models of net fertility for currently-married white couples in census years 1830–1880 and test the results with a subset of couples linked between the 1850–1860, 1860–1870, and 1870–1880 censuses. We find evidence of marital fertility control consistent with hypotheses as early as 1830. The results indicate support for several different but complementary theories of the early US fertility decline, including the land availability, conventional structuralist, ideational, child demand/quality-quantity tradeoff, and life cycle savings theories.

Abstract

Purpose

Little is known about gender relations in young African migrant families residing in Hong Kong (HK). This study aims to present a first-hand account of daily lived experiences of African international doctoral student couples residing in HK, with special emphases on their Africa–HK migratory motivations, perceptions of female-breadwinning status, the effects of HK Immigration policy on marital power structures and the influence of spousal relative statuses (“breadwinner” versus “dependent”) on couples gender role performances and decision-making participations.

Design/methodology/approach

This study used ethnographic method involving several indoor family visits, non-participant observations and 21 in-depth interviews in six African student families. Fieldnotes were taken and interviews were tape-recorded, transcribed and interpreted using thematic content analysis.

Findings

Couples, especially dependent men, had a hard time deciding to migrate to HK for family reunion, unlike dependent women who willingly resigned to join their husbands in HK. Among the male dependents, the main reasons for migrating included anticipated economic returns, while women migrated in response to neolocal cultural expectations. Overall, patriarchy persisted – while men had the final say over key household decision-making domains, women remained primary performers of household chores, but manifested little bargaining power, restraining husband’s ability to spend family income when they are the family’s sole-earners. Women’s relative breadwinning status had very minimal significant impact.

Originality/value

To the best of the author’s knowledge, this is the first study to examine the effects of HK’s immigration policy on married African students’ migration motivations and the effects of female-breadwinning status on spousal gender relations in HK’s African student migrant households.

Abstract

The Edmund Edelman Children’s Court is a juvenile dependency courthouse in Los Angeles designed with bright murals, open play spaces, and modified courtrooms to be “child-sensitive” and “family-friendly.” Through a recounting of the political and cultural forces at play building up to its construction, I argue that the decisions to build a “child-sensitive” court confirm the carceral containment of the culpable black adult. This article represents an inquiry into the cultural logic of the court’s construction, revealing the relationship between raced constructions of innocence and guilt. This study draws from five months of fieldwork conducted in the Edelman Children’s Court.

Abstract

Are organizations responding to significant changes in Australian labour force demographics by providing more family‐friendly programs? This article explores whether or not variations across companies in the implementation of work‐family programs and policies relate to demands of key constituent groups. Findings of the present evaluation indicate that certain employee demographic factors, particularly employees with dependents, women, union members, and long‐serving employees are more likely to predispose an organization to offer work‐family benefits. Employers need to be able to characterise the demographics of their workforce to plan the type of policies and programs that might be most suitable and contribute to productivity outcomes.

Abstract

Purpose

The paper deals with the child benefits system in the Czech Republic, Slovak Republic and Sweden.

Design/methodology/approach

The authors describe the systems as the key baseline for subsequent qualitative and quantitative comparison. An essential element is the quantitative comparison of child benefits using their statistically stationarised values.

Findings

The Czech and Slovak systems provide a comparable rate of coverage as the Swedish system regarding the payment of both types of benefits, i.e. child benefits and tax allowances, for the first and second child; however, from the third child, the individual differences are considerable. Albeit the concepts of Czech and Slovak systems are framed by the same historical origins and conceptual approach, they differ significantly, with Slovakia providing the lowest aggregate level of child benefits.

Originality/value

The paper provides insight into the child benefit systems in the respective countries. These systems are at the centre of attention of policymakers who are attempting to maintain birth rates and reduce child poverty. The Czech Republic has the lowest level of at-risk-of-poverty rates for persons under 16 years of age, while natality rates are comparable.

Abstract

Purpose

This paper investigates the relationship between health and labour market participation considering the potential role played by the presence of children and elderly persons (with/without disabilities) in Italian households.

Design/methodology/approach

The authors use longitudinal data from the European Union Statistics on Income and Living Conditions and full-information maximum likelihood to estimate a two-equation model (one equation for labour force participation and one for health status) with instruments to address the endogeneity of the labour force participation choice. The model is estimated separately by gender.

Findings

The authors find that while the presence of children, elderly persons or both is positively associated with the health status of both genders, the presence of disabled elderly persons exerts a negative role. As for participation, interesting differences emerge. The presence of children discourages women's participation but is positively associated with men's labour force participation. Interestingly, a caring role for elderly persons without disability emerges for both genders when the presence of children is combined with that of elderly people. Gender differences are also at work for the role of childcare services and elderly and/or disabled home care/assistance.

Originality/value

The findings indicate a possible caring role for elderly persons without disabilities, neutralizing the effect of the presence of children on the labour force participation of both genders. The results also suggest that greater coverage of care services should increase the active participation of women in the labour market.

Abstract

The rise of a performativity discourse in education in England emanates from the importation of an economic ‘market’ structure for schools in order to improve the effectiveness and efficiency of the outputs of learning and to increase the opportunity of choice for the ‘consumers’ of education (Ball, 1998). Institutions focus their policies and practice, on improving performance and survival to maintain and develop their market share. This is due to the competitive nature of a market structure. The performativity criterion of efficiency and effectiveness is an optimisation of the relationship between input and output (Lyotard, 1979). In the case of education this means both ensuring a favourable qualitative award from a national inspection service and raising the achievement levels of pupils in national tests to ensure a high position in published tables of educational performance. High ratings on these two performativity indicators improve a school’s attraction to parents and students in the educational market place. This results in improved resources, increasing the opportunity for the school to be more selective about the students it accepts and the quality of the teachers it employs.
