Abstract

Purpose

The purpose of this article is to describe an innovative research methods framework designed to address some of the persistent challenges to a social scientific understanding of civilian-led police oversight commissions.

Design/methodology/approach

The project design begins by acknowledging that oversight commissions take multiple and varied forms, which are contingent on local histories, institutional dynamics and discursive strategies for indexing racial inequality. The authors find such variation not to be an impediment to insightful research design. Rather, the methodological frame makes use of multi-sited ethnographic methods, organized at the county level across three research clusters (in this example, Milwaukee Co, WI; San Diego Co., CA; and Washtenaw Co, MI), to draw attention to the effects of such multiplicity to complicate, localize and render visible the specific practices of policing and its critique through civilian oversight.

Findings

Amongst an increasing national concern with the racialized nature of police violence, one evolving strategy for police reform among municipalities is to establish civilian oversight boards that can monitor, make recommendations for, and potentially direct police policy. However, there is very little research on such commissions, leaving many unanswered questions for proponents of evidence-based criminal justice policy. One reason for this lack is that the tremendous variability of such commissions has led some researchers to abandon hope for a comparative analysis which might offer generalizable conclusions beyond individual case studies. Lessons learned from previous reform efforts suggest that without a solid evidentiary basis, such reform efforts can easily succumb to institutional inertia or even failure. This danger is especially present when policy and practice recommendations are not based on research designs particularly attuned to making audible the experiences and concerns of the most marginalized targets of police attention.

Originality/value

The value of this method rests in its ability to provide comparative insights into the ways in which oversight commissions operate within a broader pluralized security landscape that both makes possible and constrains democratic participation along racial lines. The method contextualizes and renders audible ways of understanding, evaluating, and practicing democratic community as it is articulated through the issue of police and its oversight.

Abstract

The EU harmonisation has created changes in the military's formal and informal influence in the directions of decreased formal and informal military influence in civilian politics. The EU reforms have created changes in the mindset of the citizens, by creating changes in the security culture of the citizens and in the civil-military related political culture. The desired level of alignment has not been reached. Therefore, the study examines the areas where further alignment is required. Moving from Rebecca L. Schiff's concordance theory, the article examines the relationship between the Turkish military, the civilian politics and the society before and after the EU harmonisation process. It examines the effects of the EU harmonisation process on the changes in the civil-military balance of power, and on the related security culture and political values. The analysis focuses on: (i) increased civilian control and consequent changes in the policy of accountability; (ii) transparency building in the defence sector; (iii) parliamentary oversight; and (iv) the change in the political culture related to the civil-military issues. It also investigates the extent the EU harmonisation has achieved in building democratic civil-military relations in order to align with the EU standards.

Abstract

Purpose

The purpose of this paper is to assess the issues raised by and the possible long-term significance of the judicial review obtained by the pressure group UK Uncut into HM Revenue and Customs’ decision to forgive £10 m of interest payable by the investment bank, Goldman Sachs.

Design/methodology/approach

Using Lukes’ (2005) three dimensions of power as a conceptual framework, the paper compares this case with a similar case from the 1980s in order to discuss the importance of democratic oversight of the way in which public bodies discharge their duties, the extent to which this should override the principle of taxpayer confidentiality and the extent to which legal rules and procedures permit such oversight.

Findings

The comparison shows that, by permitting the review to proceed, greater weight was given to the importance of democratic oversight in the UK Uncut's case, but the rejection of both cases demonstrates that the tax authority is permitted very wide administrative discretion. However, whilst UK Uncut's challenge ultimately failed, it exposed aspects of the tax authority's relationship with large taxpayers to public gaze. This has contributed to demands for changes in the taxation system, which legislators might eventually feel forced to heed.

Originality/value

This paper reminds that any significant shift in public attitudes must always have a beginning, and that, even if the challenge fails, it might be the first tangible evidence of a demand for greater transparency in the administration of the tax system which might lead to future changes.

What difference is the operation of local authority health scrutiny making to the oversight and democratisation of decision making by health bodies? This article provides an insight into how a group of local authorities in England tackled the operation of a specific joint health scrutiny committee. This example highlights building relations with associated health bodies and other local authorities, choice of health scrutiny agenda, ways of working, capacity of committees, ambiguities within the policy itself, and the difficulties and challenges of adding meaningful democratic oversight to the decision‐making processes of NHS bodies. This review highlights some of the benefits of health scrutiny, but suggests that engaging more fully with patients and the public in such reviews could result in a more influential and inclusive process.

The study on democratic control over the armed forces elaborates on perceptions of the respondents in 13 countries on interaction between democratically elected political power and the military. The views of the civilian and military students are similar on many issues that relate to the role of the military in society. There are also some differences in their opinion. Civilian students are more open towards public statements and the public influence of the military than the military students, who seem to be socialised in subordinate position towards the public, and who understood the military professionalism in terms of professional autonomy. This difference is a result of the professional socialisation and correlates with the professional culture of different occupational and professional groups.

Abstract

Private foundations in the United States are powerful actors in contemporary society. Their influence stems in part from their lack of accountability – they operate free from market pressures or finding sources of funding, and they are not subject to formal democratic systems of checks and balances such as elections or mandatory community oversight. In recent decades, foundations have become increasingly influential in shaping public policy governing core social services. In US education policy, for example, the influence of private foundations has reached an unprecedented scope and scale. Although economic and electoral accountability mechanisms are absent, foundations are aware that their elite status is rooted in a wider acceptance of their image as promoters of the public good. They are incentivized to maintain their role as “white hat” actors and, in balancing their policy goals with the desire to avoid social sanctions, the ways in which they exert influence are shaped and limited by institutional processes. Drawing on rare elite interview data and archival analyses from five leading education funders, we observe that foundations seek to sustain their credibility by complying with legal regulations and by drawing on cultural norms of participation and science to legitimize their policy activities.

Abstract

Whistleblowing plays a crucial role in revealing organizational misconduct and systemic corruption in industry and government. This paper investigates changing practices of whistleblower activism, with particular reference to the role of solidarity and the increased role of support networks. Many modern whistleblower disclosures have revealed gaping flaws in the system of global governance related to a range of important social and economic issues, such as tax evasion, global mass surveillance, the use of torture and illegal wars of aggression. All these forms of systemic corruption are reliant on the use of secrecy havens to conceal the abuse from public scrutiny and democratic oversight. Counter-hegemonic social movements that oppose forms of systemic corruption can find important allies in those whistleblowers, who leak vital information about misconduct and corruption to the public. In this paper, we argue that there is a clear relationship of mutual support between whistleblowing and activist social movements, both in the process of whistleblowing and in furthering the campaigns of the social movements themselves. We theorize this, unpacking the processes and dynamics underlying the relationship, and offering a framework for analysis. The paper concludes with a discussion of the changing role of whistleblower activism and support networks in undertaking social reform and counter-hegemonic practice.

Abstract

Purpose

This study's aim was to systematically review available literature related to the establishment, purpose, operation, and effectiveness of civilian police oversight entities in the United States and to gain a deeper understanding of support, opposition, academic, public, and police expectations concerning their utility.

Design/methodology/approach

A Preferred Reporting Items for Systematic Reviews and Meta-Analyses extension for Scoping Reviews (PRISMA-ScR) was used to analyze police civilian oversight literature published between 1992 and 2022.

Findings

The authors find racially biased policing, political investment, police resistance, oversight structure, scope, and authority are key components that determine how oversight is perceived.

Research limitations/implications

Based on the methodology, the results may not be generalizable. Future researchers should consider expanding public oversight research beyond the parameters, which constrained this paper.

Practical implications

This article contains implications that should be considered by jurisdictions seeking to develop, restructure, or eliminate public oversight entities and for recognizing the concerns of advocates and opponents of public oversight.

Social implications

Civilian oversight has long been considered a potential method for public inclusion if not a means for greater public control of police. Over the past few decades, a resurgence of interest in civilian oversight has emerged.

Originality/value

This article synthesizes literature that spans 30 years of research on public oversight.

Abstract

The militarization of police has garnered great attention in recent decades. Bolstered by the wars on drugs and terrorism, police agencies have been receiving military weapons and equipment since the 1033 Program was authorized by the Department of Défense. A recent American Civil Liberties Union investigation on police raids found that militarization has occurred with almost no oversight. They studied more than 800 paramilitary raids and found that almost 80% were for ordinary law enforcement purposes like serving search warrants in people’s homes; only 7% were for genuine emergencies, such as barricade or hostage situations. Most compelling, the raids disproportionately targeted people of color. This chapter traces the history of police militarization in America, and how it has targeted and adversely affected minority communities.

Abstract

The nature, value, and neglect of integrity capacity by managers and the adverse impacts that Enron executive practices have had on a range of stakeholders are delineated. An explanation is given on how moral competence in management practice is addressed by each dimension of the management integrity capacity construct (process, judgment, development, and system) and how Enron executive practices eroded each dimension. Specifically addressed is how behavioral and moral complexity can be utilized to balance the competing values of management and ethics theories to reduce the likelihood of future Enron‐like managerial malpractice. Finally, three positive action steps are recommended to improve managerial integrity capacity and remedies are proposed for victimized Enron stakeholders.
