Abstract

Purpose

The purpose of this paper is to detail a simulation exploring the academic and real-world debates surrounding constitutional design.

Design/methodology/approach

The authors deployed this simulation in different contexts: undergraduate courses in comparative politics and middle school classrooms of gifted students in India.

Findings

In conjunction with discussion of institutional setup, such as parliamentary vs presidential systems and judicial review vs parliamentary sovereignty, the students were required to design a new constitution for a fictional country that just overthrew a brutal dictator. Throughout the simulation, the students were assigned to be the representatives of a particular ethnic group, each with distinct interests to be represented during the constitutional convention.

Originality/value

The authors detail the learning objectives and simulation setup for this constitutional convention. Finally, the authors discuss some issues raised by the students during the simulation.

Abstract

College instructors are entering a new frontier of teaching in the 21st century. Millennial students are bringing to university classrooms different experiences regarding the ways they learn and engage in critical thinking. As online universities gain more popularity across the country, higher education institutions are offering more hybrid and distance-learning courses on the Internet match the demand for using technology for teaching and learning. This action research study evaluates how the Annenberg Media digital simulation The Constitutional Convention of 1787 effected student engagement in an undergraduate history course at a community college in a metropolitan region of the Southeast. Practical suggestions are provided for college level history instructors to adapt digital simulations for teaching curricular and content skills that foster critical thinking, digital literacy, and engaged learning.

Abstract

Purpose:

The purpose of this paper is to examine the educational impulses and effects of Indigenous dialogue with the settler colonial state. Taking the Uluru Statement from the Heart, devised in May 2017 by a convention of Aboriginal and Torres Strait Islander peoples, as a starting point, and contrasting this with the 1967 Referendum campaign for constitutional reform, the paper explores the role of multiple forms and contexts of education during these processes of First Nations dialogue with the settler state.

Design/methodology/approach:

This paper draws on historical accounts of the 1967 Referendum and the 2017 Uluru Statement from the Heart.

Findings:

The paper demonstrates how education provided by the state has been used by First Nations peoples to challenge education systems and to dialogue with the settler state for Indigenous recognition and rights. It also illuminates the range of views on what education is and should be, therefore, contesting the neat and settled conceptions of education that can dominate policy discourse. Finally the historical cases show the deficiencies of settler state education through its failure to truthfully represent Australian history and its failure to acknowledge and confront the entirety of the consequences of settler colonial practices.

Originality/value:

This paper seeks to bring issues of education, politics and justice together to illustrate how the settler state and its institutions – specifically here, education – are part of an ongoing project of negotiation, contestation and dialogue over questions of justice.

Abstract

Purpose

The purpose of this paper is to examine some influential accounts of the basis for Indigenous rights, consider their strengths and weaknesses, and ascertain whether and in what degree they support effective self-government and self-determination for Indigenous people.

Design/methodology/approach

The paper begins with a brief discussion of the emergence of specifically Indigenous rights, the significance of self-determination as a means of improving the economic and social conditions of communities, and the problem such rights pose for late 20th versions of egalitarian liberalism. It then examines the liberal culturalist argument for minority rights developed by Will Kymlicka, before turning to James Tully’s elaboration of the historical approach to the justification of Indigenous rights that draws on the tradition of treaty relations in North American colonialism. Finally, it outlines a third approach based on the political liberalism of John Rawls.

Findings

The conditions of legitimate government set out in Rawls’ political liberalism are a better way to provide normative foundations for Indigenous rights in contemporary postcolonial democracies.

Research limitations/implications

The discussion of Indigenous rights is confined to those countries established by colonization with largely British political institutions and populations. The arguments for Indigenous rights are confined to those advanced within the liberal tradition of political thought.

Originality/value

Some of the criticisms of the liberal culturalist argument and of Tully’s approach are original. The case for Indigenous rights based in the legitimacy requirements of political liberalism is original and based on conceptual work by the author.

Abstract

Flexibility (enhanced cooperation) has arisen in the European Union (EU) agenda as a function of recent enlargement rounds and is now one of the key issues in the construction of the EU polity with respect to diversity management. Whether enlargement has provoked normative reform in the EU, taking flexibility as an example is the focus of this article. The author argues that the flexibility case indicates that pressures of enlargement have not produced radical normative change in the EU. Tracing the evolution of enhanced cooperation from the 2000 Treaty of Nice onwards, the evidence points towards the continued existence of the traditional ‘frame’ of the integration process rather than its rejection in favour of more radical and innovative solutions to the EU's governance problems.

Abstract

Purpose

A central question of public administration is how political principals secure the cooperation of administrators within organisational frames and contexts; increasingly, rational influences are being considered alongside bounded rationality and non-rational influences. This paper aims to explore the intent of New Zealand’s Public Service Act 2020 in managing administrative behaviour.

Design/methodology/approach

The methodology is primarily ethnographic, combining emic and etic perspectives. A mixed-methods approach comprises participant observer field notes and meeting documentation, substantiated by official documents; documents were analysed thematically and triangulated with other data sources.

Findings

The Public Service Act introduces new bounds on administrative behaviour. The stated rationale for these changes reveals an attempt to set limits on the principal–agent relationship between politicians and administrators and causes predictable deviations from rational behaviour by cultivating public service motivation and a unified public service identity.

Research limitations/implications

As the legislation in question was only passed in 2020, it is too early to definitively assess the ultimate impact of legislation on administrative behaviour. This case study demonstrates that behavioural approaches to public administration are being applied intentionally by governments. The choice architecture created in the case study blends rational, bounded, and non-rational influences. Together, this produces a bricolage of semi-relevant theories from other disciplines, especially psychology, to explain administrative behaviour. Further refinement is needed to develop a cohesive and comprehensive theory of administrative behaviour that can account for contemporary practice.

Practical implications

Administrators act as agents of political principals, within ethical and rules-based limitations and influenced by public service motivation and social identity. Shifting from implicit to explicit choice architecture does not negate possible tensions between bounds and can signal them more explicitly. Shared symbols are sometimes intended to influence identity and therefore adherence to behavioural norms.

Originality/value

This paper explores the manipulation of choice architecture as a viable strategy for altering behaviour for the better and, to the best of the authors’ knowledge, is the first known instance of choice architecture being “legislated in” rather than merely “showing through”. This study illustrates the blending of rational, boundedly rational and non-rational factors into a choice architecture for public administrators that help mediate the biases and challenges of principal–agent relationships (which form a cascade in New Zealand’s public administration system).

Abstract

Purpose

This paper is based on three social scientific studies of animal welfare and local food products in Norway, of which two focussed on sheep in particular. It addresses the widespread belief that Norwegian sheep farming is “the best” but is confronted with a meat industry that emphasises economic efficiency. A few years after a new Norwegian law on animal welfare acknowledged animals as sentient beings came into force in 2010 (LOVdata, 2009), the purpose of this paper is to better understand ongoing debates on the welfare of sheep by exploring how sheep welfare is understood and regulated in Norway.

Design/methodology/approach

The theoretical framework draws on convention theory, especially referring to the four “possible worlds of production” (Salais and Storper, 1993). The authors argue that animal welfare may be analysed in parallel to product quality, focussing on three major perspectives of sheep welfare: animal treatment, product quality, and an abstract conceptualisation in public discourse. The empirical analysis is based on interviews with key players in the sector and central documents.

Findings

Convention theory points to several general difficulties in reaching an agreement on what is “good quality” and welfare. First, the authors find difficulty in how to implement new regulatory conceptualisations with dominant ways of understanding welfare within the industry. Second, the idealised images of sheep welfare of an immaterial possible world dominating public discourse have very little interaction with the real world of farms and abattoirs.

Originality/value

This paper suggests that rather than addressing and handling the potential tension between the legal recognition of animal as sentient being and the economic demands of the industry, key actors keep the potentially conflicting understandings apart in different “worlds of production” (Salais and Storper, 1993). Nevertheless, the authors observe that interactions between possible worlds, as well as translation from one possible world to another, not only could be promising but would be fundamental to concretise improvements in the real world.

“All things are in a constant state of change”, said Heraclitus of Ephesus. The waters if a river are for ever changing yet the river endures. Every particle of matter is in continual movement. All death is birth in a new form, all birth the death of the previous form. The seasons come and go. The myth of our own John Barleycorn, buried in the ground, yet resurrected in the Spring, has close parallels with the fertility rites of Greece and the Near East such as those of Hyacinthas, Hylas, Adonis and Dionysus, of Osiris the Egyptian deity, and Mondamin the Red Indian maize‐god. Indeed, the ritual and myth of Attis, born of a virgin, killed and resurrected on the third day, undoubtedly had a strong influence on Christianity.
