Abstract

Purpose

The creation of public value is a topical debate for Dutch civil society organizations. Over the years, moving from government to governance, they supposedly have gained responsibility and space in meeting public needs. However, meeting the priority public needs and demonstrating actual public value creation has proved difficult. This has led to many discussions on how and if these organizations are creating public value. This study therefore investigated three practical cases to explore and explain how managers of housing associations create public value.

Method

A case study method was employed.

Findings

Based on the different cases we can conclude that despite high ambitions, deviating normative views and the will to change displayed by the managers in the cases we investigated, we did not encounter situations where managers actually managed spaces for the creation of public value. The involved managers are still led by formal agendas and policies, rather than engaging in dialogues with their relevant stakeholders. They remain segmented in their approach and offering of services. Managers’ environment and stakeholders are not yet naturally seen as a place for sharing information and reframing boundaries for creating public value.

Originality/value

The opportunity in the investigated cases and for these managers lies in mobilizing and utilizing network relationships. This article provides a public value praxis model that focuses on involving stakeholders in investigating priority needs, collectively (re)designing services that meet these.

Abstract

Paradoxes are historically embedded in institutions and organizations. Latent paradoxes pose danger if they become salient; sociological analyses can identify historically embedded latent paradoxes. The emergency management paradox, in which the state invests vast resources, establishing formidable organizational arrangements that rely on knowledge to respond to unanticipated events in advance of their occurrence, even though such events can only ever be known after they occur, is a paradox of this kind. Deploying methodological “dual integrity” we trace through historical description and sociological conceptualization the institutional and organizational history of the emergency management paradox in Australia, where uncontrollable bushfires are becoming increasingly common, before drawing more general conclusions about how a response to grand challenges, such as climate change, demands an interdisciplinary understanding of the rituals and realities of paradoxes that emerge historically from our collective attempts to handle uncertainty via risk. Our research serves as a warning of the grave consequences that can result from ignoring a paradox’s history, whether intentionally or unwittingly.

Abstract

In a highly globalized, interconnected and interdependent world, universities can no longer survive in isolation. The educational, research and social actions have an impact on the community where the university works as a change agent to promote society’s fundamental values of democratic participation and social justice. Sustainability education and awareness about social responsibility (SR) are becoming crucial mainly for students, so that they are aware of concepts such as economic prosperity, resource equity, energy sustainability and environmental health concerns (Sengupta, Blessinger, & Yamin, 2019). The SR of a university is to strengthen its ties with the community through promotion of active citizenship, volunteerism and developing a sense of civic and ethical responsibility among students and staff. Universities can have a great influence on achieving social and economic progress of a country as well as protecting the environment and addressing complex issues that plague society. The role of universities is not only restricted to exchange of knowledge but also in playing a leading role as an active member of society. Universities have come out of their isolation to accommodate and be a part of social change by actively engaging in community life and not being confined to only classroom and laboratory activities (Sengupta et al., 2019). This book provides empirical evidence on how universities have considered SRs as their prime focus and have engaged with civil society to enhance their values. Case studies from Indonesia to the United Kingdom enrich the book through their experience, interventions and narrations, which can be replicated in other parts of the world to create a better society and a more sustainable planet.

There has been growing concern among international agencies and the corporate world regarding the question of sustainability and how long we can preserve our planet and ensure just and balanced development for all. Non-governmental organizations, labor leaders, faith-based organizations, religious leaders, and other civil society representatives play a crucial and diverse set of roles in societal development. At the same time, institutions imparting higher education are engaging in debates and quality research work to gauge the need of our current generation with a vision to meet the need of the future generation. Abstract

The purpose of the research is to determine the essence and notion of economic violation of law and their varieties, and to determine the reasons that lie in the basis of this negative social phenomenon. The authors use the philosophical law of integrity and struggle of contradictions and rather-legal, historical and legal, and formal and legal methods of scientific cognition. Such laws of dialectics and transition of quantitative changes into qualitative changes, negation of negation, and others are used. Signs and types of economic violations of law are analyzed and their predetermination by the conflict character of economic relations is noted. Comparison of economic violations of law that are peculiar for administrative and market models of economy is performed. The universal character of economic relations as objects of legal protection is shown. Classification of economic violations of law, based on the level of their public danger and spheres of distribution, is provided. Special attention is paid to civil and legal violations of law as a variety of economic violations of law, based on not anti-social settings of the subject but conflict with the borrowed system of values, which is alien to most members of society. The notion “economic violation of law” is of the collective character and includes illegal actions regarding economic relations, and the latter are of the conflict character due to different interests of subjects, the existing competition, and striving for obtaining profit. Economic violation of law is an illegal form of solving the existing conflict, which leads to application of measures of legal responsibility. The causes of economic violations of law could be overcome by implementation of the values and ideals of justice in the legal norms. They should be based on historical, cultural, spiritual, and legal traditions. All that is imposed artificially is destined for rejection and creation of new conflicts, including economic violations of law.

The chapter will examine the emergence and influence of the restorative justice movement as a bridge between communities, civil society and the state in Ireland. The chapter will focus on the Republic of Ireland, but will also examine restorative conferencing in Northern Ireland. This will be divided into a number of sections, each reflecting the emergence of a movement dedicated to the promotion of restorative justice as a vehicle for a holistic form of community-based justice in Ireland. This chapter covers the history, scope, and philosophical-political background of the restorative justice movement, providing specific examples of the interchange between this restorative justice movement and civil society in Ireland, Northern Ireland and the United States. The wider potential of the restorative justice movement will be highlighted.

This potential is demonstrated in the restorative movement’s challenge to understandings of failed punitive approaches, and through its socially redemptive alternative which emphasises collective responsibility for crime amongst all of the community. The chapter will also examine the international background to restorative justice, and its theoretical understandings, with a focus on key theorists such as Strang and Braithwaite, amongst others. It will examine salient issues that underpin social justice and social control in Ireland, including the potential impacts of restorative justice policy and practice for the wider community and the state.

The primary goal of the Restorative Justice process is not punishment but making good the harm done by offending for the victim, the community and the offender. Offenders have to take responsibility for their actions as a precondition to addressing the harm that they have caused. Offenders become aware that a crime is committed, not against an abstraction, but against someone real, a person like themselves and against their community, who are directly and indirectly affected by what has happened. Crime and conflict affect relationships between individuals who are left outside the court system altogether by conventional justice. Proceedings and arguments of the restorative process are voluntary for all parties. People are given the opportunity to partake in mediation, or to accept reparation. The process is always confidential however; outcomes and agreements can be made public, depending on the authorisation by participants.

Codes of conduct have been adopted very broadly on both sides of the Atlantic in the last two decades. They have been introduced for both elected representatives and appointed officials. Though the accountability mechanisms vary, elected politicians prefer self-policing and enforcement. For appointed officials who carry out specialized functions with exposure to particular, clearly identifiable, ethical risks, where the need for public trust and confidence is great, it is important but also relatively straightforward to develop codes of practice. For generalist public servants, the situation is different. The range of ethical risk to which civil servants are exposed is broader. It is less easy to be specific about the risks involved.

This chapter discusses reforms to increase customer-centredness, public consultation (including professional, business and community associations), whole-of-government approaches (a case of trafficking in persons), increased budget, personnel and procurement delegation to departments and increased role of statutory boards (autonomous agencies). According to the author the driving force behind public sector reforms emanates from the inner core of ministers, most particularly the prime minister and deputy prime minister, working in close conjunction with senior permanent secretaries, directors of boards and government-linked companies. In Singapore, power is concentrated in the hands of political executives and senior levels of civil service. Ministers set the policy agenda and make final policy decisions on important issues. The administrative service is the elite service (of about 250 persons) within the civil service that shapes policy, especially permanent secretaries and deputy secretaries. Objections to reforms are often avoided through inputs to the reform process by key stakeholders and experts of relevant fields from inter-ministerial and inter-agency committees and through public consultations. Singapore has achieved an exceptional level of prosperity, and according to the author civil service is guided by practices of meritocracy (e.g., in promotion) and strict accountability through audits and anti-corruption steps.

Abstract

Purpose

The chapter aims to explore the corporate social responsibility (CSR) policy domain at EU decision-making level, aiming to understand the nature of the participation shaping the CSR policy agenda co-design.

Design/methodology/approach

Building on a conceptual framework of participation, the chapter highlights the literature and policy views around the importance of EU CSR policy and how EU envisage the framework of the CSR policy co-design. By highlighting conceptual dimensions of the participatory governance, different levels of participation that shape the policy are evidenced. In particular, a case analysis emphasising the predominant role of the consultation approach in the decision-making process of the CSR policy is undertaken.

Findings

The findings shed light on the shift from the traditional passive participation in EU CSR policy decision making, based on purely communications towards consultation and multi-stakeholders participation. From the multi-stakeholder perspective, the EU Multi-Stakeholder Forum’s strategic relevance is observed, however, with no clear mechanisms to enforce its aims. Although the CSR policy is a core priority on the policy agenda, its voluntary approach justifies its early stages of implementation and fragmented use.

Research limitations/implications

The research is qualitative, based on literature review and policy view. Further research directions could enrich the chapter.

Originality/value

The research contributes to the theoretical discussion around participation in a supranational context. Our insights shed light on the levels of participation and CSR policy goals and call for a critical debate on the EU policy co-design processes. Furthermore, through the lens of a case analysis, it sheds light on how EU CSR forum fits in with the current EU structure and its ‘principle of subsidiarity’, which states that decisions must be taken close to its citizens.
