Abstract

Members of Congress become involved in scandals on a regular basis. These range from personal imbroglios, like sexual affairs or substance abuse, to professional scandals like embezzlement of campaign funds, abuse of office, or insider trading. As a common feature of congressional life, scholars have shown that scandals frequently disrupt the electoral and legislative trajectories of representatives' careers.

However, it must be remembered that congressional offices are comprised of more than just an individual member. Congressional offices are legislative enterprises, and a representative's staff are integral to his or her political and lawmaking activities. Accordingly, studying how scandals relate to the careers of congressional staff is an important but overlooked topic.

In this chapter, the authors investigate the relationship between members' malfeasances and the careers of the staff around them. The authors combine a list of congressional scandals with a dataset that captures the turnover of staff in congressional offices. The chapter proceeds in four parts. First, the authors describe the structure of a congressional office and the relationship between members and their staff. Next, the authors provide an overview of scandals in Congress and what previous literature has uncovered about their effects. Third, the authors examine staffing patterns and turnover in offices hit by scandal, uncovering evidence that scandals are associated with staff departures. The authors end by considering how Congress as an institution could help to protect and support employees who are caught up in a member's poor choices.

Abstract

This chapter examines the relationship between constitutional guarantees of sex equality, understood as prohibiting unequal treatment between men and women, and the constitutional protections of maternity. Textual guarantees of sex equality are nearly universal in constitutions around the world, and many constitutions in Europe, Latin America, and Asia also include provisions guaranteeing mothers the special protection of the state. In the United States, by contrast, the special treatment of mothers has long been contested as a threat to gender equality, and the efforts to add a sex equality amendment to the U.S. constitution have failed over the past century because of conflicts about the status of motherhood. This study traces the origins and jurisprudential development of maternity clauses in European constitutions to shed light on the possibility of synthesizing maternity protection with a constitutional commitment to gender equality.

Abstract

The present paper takes a look at the particularities of German strategy research over the last three decades. In contrast to much of the Anglo-Saxon research, which has focused on competition as a guiding concept in theorizing about strategy, German research has typically been concerned with more fundamental questions about the general relationship between organizations and their environments and, as a result, tended to be more conceptual than empirical. Researchers have been particularly influenced by the German sociological and philosophical traditions, specifically by the critical theory of Jürgen Habermas and by the systems theory of Niklas Luhmann. Also, there are authors who draw on the economic tradition of the Austrian School in order to develop a competence-based theory of the firm. Another branch builds on Anthony Giddens's structuration theory and Jacques Derrida's philosophy of deconstruction. As we will demonstrate, much of the research has been concerned with fundamental theoretical tensions: evolution vs. planning, selection vs. compensation, cognitive–instrumental rationality vs. moral–practical rationality, etc. We note that, as a consequence, much of German strategy research shows a particular interest in paradoxa and oxymora (such as ‘planned evolution’, ‘productive misunderstandings’ or ‘unfocused monitoring’). This paper will identify and explore important strands of German strategy research and discuss its particularities compared to mainstream strategy research in the United States.

Abstract

Recent academic studies, as well as media reporting, have devoted substantial attention to the ongoing “crisis of democracy.” Democratic “backsliding” of Central and Eastern Europe – sometimes referred to as an effort to establish a new system of “illiberal democracy” – is one of the most visible symptoms of this crisis. This narrative is supported by the quantitative metrics of democratic quality, reflecting professional community views on the appropriate criteria to define and assess democracy. However, once general public views expressed in the survey item of “satisfaction with democracy” are taken into account, the picture changes markedly. This chapter analyzes quantitative metrics reflecting expert community consensus and the general public assessment of the quality of democracy in the 27 EU members over the period 2010–2019. It documents substantial divergence between the perspectives of the experts and the general public – while expert-based indexes portray Central and Eastern European backsliding as the most significant trend in the EU democratic landscape, public opinion identifies a very different set of democracy's successes and failures. As experts and the general public fail to arrive at mutually accepted criteria of democratic performance evaluation, public debate has become futile. Meaningful discussion and systemic corrections have become unlikely, creating conditions easily exploitable by the populists, eager to frame it as an example of “elite” detachment from the “ordinary people”.

Abstract

The significance of literature in nation-building in two “second generation” nations, Germany and Norway, is discussed. In both countries a specific national literature was constituted parallel to the political institutions during the latter half of the 19th century. Yet there are clear differences in political effects in the two cases. In Norway, the struggle for national independence up to 1905 entailed a significant democratization of society. Germany, in the wake of the revolution of 1848, developed into a politically authoritarian regime, fully established under Prussian leadership in 1871.

These processes are mirrored in the position of literature. In Norway, where artistic traditions were absent, the national literature was a product of the 19th century, and emerged in close connection to ongoing political debates. In Germany, the Weimar heritage had gained classical status during the 1850s. Thus, the problem was foremost that of redefining the spiritual heritage to fit the history of the German Reich.

A related difference is found in the diffusion of literature through its most important channel – the school system. Norway developed a modern, uniform school, where the nation’s new literature was accorded a central place. In Germany, a more class-based school system was cemented, and the idea of diffusing the cultural heritage to the population at large held a weak position.

Along with these institutional factors, the development of national literatures in the two countries is seen in the light of regional specificities, constellations of literary genres with high and low prestige, and the social and political position of writers.
