Abstract

Purpose

To analyze the evolution of market manipulation and fraud by short-sellers and online bloggers and mechanisms available for addressing and remediating the damage caused by such fraud, including recent activity by the US Securities and Exchange Commission (the “SEC” or “Commission”).

Design/methodology/approach

This article discusses the development of a modern market manipulation and fraud scheme – the “short and distort” – including a review of potential claims by the targeted companies and anticipated impediments to asserting such claims.It further examines the need for regulation and the possibility that the SEC has opened the door for civil claims for this type of fraud.

Findings

Companies wrongfully targeted by illegitimate short-sellers may pursue claims for securities violations, defamation, business interference, securities fraud and extortion, among other claims.However, each of these claims has had, and still has, both business and legal challenges, as the short-seller’s initial defense tends to be to attempt to prove the truth of their statements to the market or establish those statements as legitimate opinion.The SEC has made the pursuit easier but there is still a long way to go.

Originality/value

This article contains valuable information about recent SEC enforcement activity and practical guidance from experienced securities lawyers.

Abstract

We propose that the ambiguity of discourse around a category – rather than being problematic – improves the longevity of that category. This is especially true in the creative industries. Using methods and theories drawn from sociology and art history, we tested this thesis using swing as a case study. Based on three years of archival research we found 70 co-existing definitions of swing and 89 different uses of the term. These multiple meanings enabled various understandings to come in and out of focus over time, contributing to swing’s longevity. Our findings extend to other categories within the creative industries.

Abstract

Alternative education settings (AES; i.e., self-contained alternative schools, therapeutic day treatment and residential schools, and juvenile corrections schools) serve youth with complicated and often serious academic and behavioral needs. The use of evidence-based practices (EBPs) and practices with Best Available Evidence are necessary to increase the likelihood of long-term success for these youth. In this chapter, we define three primary categories of AES and review what we know about the characteristics of youth in these schools. Next, we discuss the current emphasis on identifying and implementing EBPs with regard to both academic interventions (i.e., reading and mathematics) and interventions addressing student behavior. In particular, we consider implementation in AES, where there are often high percentages of youth requiring special education services and who have a significant need for EBPs to succeed academically, behaviorally, and in their transition to adulthood. We focus our discussion on: (a) examining approaches to identifying EBPs; (b) providing a brief review of EBPs and Best Available Evidence in the areas of mathematics, reading, and interventions addressing student behavior for youth in AES; (c) delineating key implementation challenges in AES; and (d) providing recommendations for how to facilitate the use of EBPs in AES.

Abstract

Purpose

Despite their documented benefits, evidence-based practices (EBPs) for early childhood social learning are not systematically implemented. Teachers are key players in the implementation process of intervention programs and instructional practices. This is a viewpoint about teachers’ attitudes towards EBPs and their role in the successful implementation of EBPs for early childhood social learning.

Design/methodology/approach

The viewpoint draws on theoretical models of intervention implementation and innovation adoption to explore the importance of individual factors for EBPs implementation and to inform the understanding of the relationship between teachers’ attitudes and EBPs implementation in the context of early childhood social learning. Additionally, it is informed by the literature on research-informed teaching to identify novel opportunities of cultivating positive views towards EBPs for early childhood social learning.

Findings

According to implementation science, in addition to macro-level social and organisation factors, micro-level individual factors that pertain to professionals’ attitudes towards EBPs are related to successful adoption and implementation of EBPs in organisations. Hence, it is important that the investigation of the adoption and implementation of EBPs for early childhood social learning considers the role of teachers’ attitudes towards EBPs. A conceptual model is proposed to explain that research-informed teaching could contribute to fostering positive attitudes towards EBPs for early childhood social learning by raising awareness of the value and potential of research to transform pedagogy.

Originality/value

This viewpoint draws on EBPs implementation science to identify important factors of EBPs adoption and implementation for early childhood social learning that have not been considered extensively and offers a conceptual framework to help understand how research-informed teaching could be an innovative avenue of promoting EBPs implementation in education.

Abstract

Can we speed the testing, implementation and spread of management innovations in a systematic way to also contribute to scientific knowledge? Researchers and implementers have developed an approach to test and revise a local version of an innovation during its implementation. The chapter starts with a case example of an application of this combination of implementation and quality improvement sciences and practices (improve-mentation). It then summarizes four examples of this approach so as to help understand what improve-mentation is and how it is different from traditional quality improvement and traditional implementation of evidence-based practices. It considers gaps in knowledge that are hindering both more use of improve-mentation to generate scientific knowledge about spread and implementation, as well as more use of improve-mentation by health care service organizations and researchers. It closes by proposing fruitful research and development that can address these knowledge gaps to speed the implementation, sustainment and spread of care and management innovations.

Abstract

The ongoing global pandemic poses significant challenges for researchers, personally and professionally, as it does for all people. However, even if we cannot safely leave our home to gather qualitative data by directly meeting with people, opportunities abound for engaging in discourse analysis. After all, people have not stopped talking or writing, even if much of that is now via Zoom, social media or some other technology platform rather than face to face. What people are talking and writing about at this time matters greatly because language use profoundly shapes how people interpret reality, perceive themselves and others and act. Quite literally, then, the discourse people engage in and are influenced by during the pandemic may help to save or imperil lives and livelihoods. While there are many possible approaches to discourse analysis, this chapter focuses on some key insights French philosopher and social theorist Michel Foucault offers for such endeavors. It offers an introductory account of his key concepts and methods, followed by a brief case study to demonstrate their application to discourses that reject scientific knowledge and advice about COVID-19.

Purpose

A proposed typology of moral exemplars in business highlights instances selected to illustrate standards for inclusion. The typology distinguishes among champions, heroes, and saints as different kinds of business exemplars. The typology reflects variations in both specific decision conditions and moral value emphases of business actors. The typology also differentiates moral exemplars from moral neutrals (i.e., amoral actors) and moral sinners (i.e., moral value scofflaws). The objective is to advance understanding of moral character and moral courage in business settings.

Methodology/approach

The methodology combines original conceptual argument and brief case summaries taken from available literature. The chapter is not a systematic survey of literature but cites key works. Construction of the typology involved iteration between conceptual development and case interpretation.

Findings

The chapter separates business cases into private business and public business, and applies Adam Smith’s distinction between citizenship and good citizenship. An additional distinction is made between extreme conditions and normal conditions. Moral heroism in business is restricted to life-and-death or strongly analogous situations in extreme conditions such as hazardous whistleblowing. Moral sainthood in business involves extreme maximization of a single value going far beyond simple compliance with legal requirements and typical ethical norms – Smith’s definition of citizenship. Moral championing in business concerns some degree of lesser self-sacrifice in defense of important values reflecting Smith’s definition of good citizenship.

Research Limitations and Implications

The chapter is a selection of literature undertaken in iteration with the conceptual development effort. The original research aspect of the chapter is thus quite limited. The author is not positioned to judge the accuracy of published information, for or against a particular instance. The classifications thus depend on whether the instance would, if the generally reported facts are basically accurate, serve as a reasonable illustration of standards for inclusion. Criticisms have been made concerning some of the instances discussed here.

Practical Implications

The emphasis is on providing standards for defining moral exemplars for business to suggest how much can be accomplished in business through moral influence.

Originality

The conceptual contribution is original, although drawing on the philosophical literature debate about saints and heroes. The chapter treats exemplar as the overarching construct, separated into three kinds: heroes, saints, and champions. Sinner is implicit in the notion of saint. The chapter adds moral champions and moral neutrals to isolate moral heroism. The cases exist in the literature, but have been combined together here for the first time.

Abstract

Purpose

The aim of this paper is to examine how crises can be triggered online, how different social media tools escalate crises, and how issues gain credibility when they transit to mainstream media.

Design/methodology/approach

This exploratory study uses the multiple case study method to analyze five crises, generated online, throughout their life-cycles, in order to build analytic generalizations (Yin).

Findings

Crises are often triggered online when stakeholders are empowered by social media platforms to air their grievances. YouTube and Twitter have been used to raise issues through its large user base and the lack of gatekeeping. Facebook and blogs escalate crises beyond the immediate stakeholder groups. These crises are covered by mainstream media because of their newsworthiness. As a result, the crises gain credibility offline. Mainstream media coverage ceases when traditional news elements are no longer present.

Research limitations/implications

If crises are increasingly generated online, this study aims to apply a framework to manage the impact on organizations.

Practical implications

How practitioners can use different new media tools to counter crises online and manage the transition of crises to mainstream media.

Originality/value

This is one of the first few studies that analyses how organizational crises originate online, gain traction and get escalated onto mainstream media. Understanding what causes crises to trigger online and gain legitimacy offline will enable practitioners to engage in effective crisis management strategies.

A confluence of events has created an opportunity to rethink special education, including the lingering effects of the COVID-19 global pandemic, advances in technology, and changes in how special education is conceptualized and delivered. In this chapter, I discuss each of these in turn and then describe three possible futures for special education: maintain the status quo, revolutionize and revitalize special education, or abandon special education completely. The possibilities and implication of these alterative futures for students with disabilities are then considered.

Abstract

Purpose

This paper aims to illustrate how a company's current 24‐hour e‐mail culture impacts on employees' lives outside of their contracted working hours. There are two objectives of the study – first, to calculate the average time spent on work e‐mails by employees per day outside of working hours and, second, to identify what impact e‐mail had on employees' work‐life balance by addressing three research questions. These questions aims to focus on the relationships between: employees' thoughts about company culture and their belief that their work is dependent on them checking their e‐mails outside of working hours; employees' urges to check e‐mails out of working hours and their belief that spending time on e‐mails outside of work means they are neglecting their social life; and employees sending e‐mails out of office hours and their expectation of a quick reply or action.

Design/methodology/approach

A case study approach was taken. Employees from a multinational service organisation were invited to complete an online questionnaire and a seven‐day diary so as to collect qualitative and quantitative data about their use of e‐mail.

Findings

Data were analysed with respect to respondents' gender, role and length of service in the organisation and discussed with respect to the current literature.

Research limitations/implications

Although the limitations of exploring a single organisation are recognised, it is likely that some of the insights and lessons generated by the study will be transferable to other organisational settings.

Practical implications

This study identified some short‐term recommendations as to how a particular company could limit the negative impact that e‐mails have on its employees' lives outside of contracted working hours. In addition, this study will also raise awareness of the pervasion of work‐related communications into employees' personal lives and, hopefully, trigger further research into the long‐term psychological and sociological effects of a 24/7 communication culture.

Originality/value

There are two novel aspects to this study: the use of diaries as a method of data collection and the notion of exploring e‐mail use “out of hours”.
