Abstract

Centres on measuring lodging operator compliance with regard to the Americans with Disabilities Act (ADA). The intent was to measure current level of physical compliance with the ADA; future plans in meeting or exceeding ADA requirements; and barriers which impeded complete compliance. The participants in this study were selected from a list of hotels and motels contained in the 1994 version of the Hotel and Travel Index. The lodging operations were represented by full service, limited service and economy properties which varied from 25 to 615 guest rooms per property, restaurant, and meeting facilities. The findings of this study suggested that total compliance has not been achieved in certain areas, vagueness of the legislation is not necessarily a barrier in compliance, and financial constraints are a barrier in non‐compliance. Implies that lodging operators must properly position their products and services, otherwise the disabled travellers’ needs will not be totally met, and that lodging operators need to continue their civic respon‐ sibility for meeting the needs of the disabled travellers’ needs.

Abstract

The role that the disabled have been confined to play in our work force changed drastically with the enactment of the Americans with Disabilities Act on July 26,1992 for employers with twenty‐five or more employees. Indeed, as of July 26,1994 the law will also apply to employers with 15–24 employees. The focus of ADA is to enable individuals with physical or mental disabilities to enjoy equal employment opportunities by removing obstacles such as job requirements that are not in alignment with the essential duties of the position. The law also requires employers to make reasonable accommodations that do not impose an undue hardship on the organisation but are considered key in assisting a disabled applicant or employee in performing the essential duties of the job. Originally drafted by Robert Bergdorf, associate professor of law at the District of Columbia School of Law, the ADA became the seventh major component of the federal equal employment opportunity law that prohibits employment discrimination. The Equal Employment Opportunities Commission (EEOC) has responsibility for the enforcement of the employment component of the ADA, also known as Title I.

Abstract

Before turning our attention to the recent developments in employment of the disabled and becoming familiar with these developments, it is important to define what the words disability and handicap mean in general. The majority of us use these two words interchangeably. There is, however, a difference in the meanings that should be understood before any further examination into the topic is made. Disability is the functional limitation within the individual that is caused by physical, mental, or sensory impairments; handicap is the loss or limitation of opportunities to take part in the normal life of the community on an equal level with others due to physical and social barriers [5]. Until the end of 1992, over 251,000,000 persons were classified as disabled in the United States. Males account for 49%, while females make up 51% of this population. There is also a strong relationship between age and the likelihood of a disability. Persons 65 years and over made up 12.2% of the total population, but they accounted for 33.8% of all persons with a disability. Persons with low incomes are more likely to have disabilities than persons with high incomes. As far as employment goes, the employment rate among both sexes for persons with no disability was 80.5%, but the rate was 24.1% for disabled persons [5]. People with disabilities have unfortunately not been part of the American mainstream and are still excluded from full participation in society. Millions are seeking employment so they too can earn a living and become socially and economically independent. Such employment statistics brought about the Americans with Disabilities Act (ADA). The ADA is the most significant federal civil rights legislation that has affected and will continue to affect private employers since the passage of Title VII of the Civil Rights Act of 1964. It was signed by President Bush on July 26,1990. For employers with 25 or more employees, the ADA went into effect July 26, 1992; and for employers with 15–24 employees, it went into effect on July 26,1994. Companies with less than 15 employees are exempt from the job‐bias rules. Stated in the most simple terms, the ADA will prohibit discrimination in employment and in access to public services based upon disability. Employers must now provide reasonable accommodation to disabled employees and applicants as long as this does not inflict undue hardship on the business. Three major barriers currently exist for working‐aged disabled people: discrimination, lack of employment opportunities, and places with reasonable accommodations for the disabled.

Learning outcomes

Upon completion of the case study, the students will be able to conceptualize the importance of brand differentiation; suggest the implications of brand differentiation in the context of the traditional Chikan art form; examine the aspect of a brand’s product portfolio management; and critically analyse the competitive advantages of the brand using the VRIO framework.

Case overview/synopsis

The Chikankari art form gained worldwide recognition. In fact, it also received a geographical indication (GI) tag which is important for international branding. The case is centred around an entrepreneur, Mr. Vinod Punjabi, who redefined the essence of the existing Chikan art form by value addition in terms of intricate designs, patterns and exclusivity. He founded the brand Ada in 2015 aimed at preserving the traditional art form while curating elegance and exclusivity in its product portfolio. The case outlined Punjabi’s journey. The protagonist carefully analysed the open and unorganized Chikankari market and adopted the strategy of brand differentiation to stand apart from the competitors. Punjabi’s daughter, the chief operations officer of Ada, described the aspects. The journey was arduous, but over the years, Ada emerged as a successful name in the Chikankari market. The brand’s intent of becoming synonymous with Chikankari was successful owing to its authentic and exclusive hand-crafted products in the competitive environment of machine-made replicas. Furthermore, the brand also consistently worked on the aesthetic appearance of its store to attract a wide range of customers. Punjabi ensured that the brand was an amalgamation of all the essential elements for its survival in the long run.

Complexity academic level

The case is aimed for students pursuing bachelor’s and master’s degrees in business administration/diploma in management, marketing and entrepreneurship. Furthermore, it will assist the management trainees in gaining valuable insights.

Abstract

Section 504 of the Rehabilitation Act and the Americans with Disabilities Act prohibit schools from discriminating against otherwise qualified individuals with disabilities because of their impairments. The major difference between the two statutes is that the former applies only to recipients of federal funds, whereas the latter extends protections to those in the private sector. Otherwise qualified individuals with disabilities are those who have physical or mental impairments, which substantially limit one or more of their major life activities, a record of such impairments, or are regarded as having such impairments but who are capable of meeting all of a program's requirements in spite of their disabilities. In this chapter, the authors review the statutes' various requirements as they apply to both students and employees in the school setting. Specifically, using numerous court cases as examples, the chapter outlines the reasonable accommodations schools must provide to extend the benefits of their programs to individuals with disabilities in terms of providing services or employment. Furthermore, the chapter discusses the limitations on the types of accommodations schools must provide when doing so would place an excessive financial or administrative burden on the school board.

Understanding how leaders make foreign policy and national security decisions is of paramount importance for both the policy community and academia. It is our assertion that decisions in these domains can be explained best by tracing the cognitive process leaders go through in formulating and arriving at their decisions, using the applied decision analysis (ADA) method.

Consequently, this chapter introduces readers to Applied Decision Analysis (also see Mintz, 2005; Mintz & DeRouen, 2010), which is utilized throughout the chapters comprising this volume. We describe the methodological and theoretical implications of the research findings presented in this edited volume. Specifically, the range of leaders analyzed in this volume using ADA (namely, Vladimir Putin, Recep Tayyip Erdoğan, Khaled Mashal, Mao Zedong, and Saddam Hussein) substantiates this method’s capacity to provide robust analysis of decisions made by leaders from diverse nations and cultures. We conclude this introduction by providing a brief summary of the chapters that are included in this volume.

This volume is the second of two volumes analyzing decision-making, policy, and strategy of 12 prominent political leaders from the East and West through the lens of ADA. The chapters comprising both volumes seek to uncover how political leaders make decisions: their decision calculus and the motives and factors affecting their crafting of foreign as well as national security policies. The concluding chapter outlines the empirical and analytic contributions of ADA and poliheuristic theory to analysis that should be undertaken in national security and foreign policy affairs. Specifically, the chapter underscores ADA’s policy relevance and ramifications vis-à-vis intelligence analysis, international security analysis, as well as cross-cultural decision-making studies of rivals and allies.

Abstract

Purpose

Advanced driving assistance system (ADAS) has been applied in commercial vehicles. This paper aims to evaluate the influence factors of commercial vehicle drivers’ acceptance on ADAS and explore the characteristics of each key factors. Two most widely used functions, forward collision warning (FCW) and lane departure warning (LDW), were considered in this paper.

Design/methodology/approach

A random forests algorithm was applied to evaluate the influence factors of commercial drivers’ acceptance. ADAS data of 24 commercial vehicles were recorded from 1 November to 21 December 2018, in Jiangsu province. Respond or not was set as dependent variables, while six influence factors were considered.

Findings

The acceptance rate for FCW and LDW systems was 69.52% and 38.76%, respectively. The accuracy of random forests model for FCW and LDW systems is 0.816 and 0.820, respectively. For FCW system, vehicle speed, duration time and warning hour are three key factors. Drivers prefer to respond in a short duration during daytime and low vehicle speed. While for LDW system, duration time, vehicle speed and driver age are three key factors. Older drivers have higher respond probability under higher vehicle speed, and the respond time is longer than FCW system.

Originality/value

Few research studies have focused on the attitudes of commercial vehicle drivers, though commercial vehicle accidents were proved to be more severe than passenger vehicles. The results of this study can help researchers to better understand the behavior of commercial vehicle drivers and make corresponding recommendations for ADAS of commercial vehicles.

Outlines the underlying rationale for the North American Free Trade Agreement (NAFTA) between Canada, Mexico and the USA; and evaluates its impact from 1987 to 2000. Examines statistics on trade between the three countries and discusses changes in trade patterns and growth rates, providing a breakdown of US exports by state and industry. Shows an improved pattern and volume of trade, considers the impact on employment and admits that assessment of NAFTA’s costs and benefits is difficult. Sees Mexico as its main beneficiary so far, but predicts that this will change in the long run.

Abstract

Purpose

The purpose of this paper is to comparatively study the library and information services provided by three academic libraries – Baku State University Scientific Library, ADA University Library and Information Services and Khazar University Library and Information Center – located in Baku, Azerbaijan. Various types of library services are examined in terms of funding, acquisition and technical equipment support issues. Also, different subordination conditions (public/private) of the universities help to better understand the current position of academic libraries in different entities.

Design/methodology/approach

Most part of the conveyed information was obtained through review of related literature, libraries’ annual reports and personal communication with the directors of the academic libraries, to look for similarities and differences in provided library and information services. The results of the study are comparatively described through multiple tables and charts.

Findings

For improving services it is necessary to develop paid forms of library and information services, maintain various training possibilities for library staff in modern librarianship areas, increase the variety and number of public and outreach activities.

Research limitations/implications

As the findings of the paper suggest new forms of library services and activities, it is necessary to continue the topic in further studies to develop practical methods and applications for local library conditions.

Originality/value

The paper can be accepted as the first comparative study of the library information services in academic libraries of Azerbaijan, which gives general overview and analysis of separate service ranges and types. The researchers interested in Azerbaijani librarianship may find it practical.
