Special Issue on Law in the built environment
The law regulates and constrains the work of all those concerned with the design, development and management of our built environment. It also provides the context for the many professional negotiations which surveyors, architects, engineers and valuers routinely undertake on behalf of their clients. And, of course, it defines the nature and extent of the responsibilities which these professions owe to their clients.
The importance of this part of the professional knowledge base is already recognised in the ongoing education and training of Built Environment practitioners. Law modules occupy a significant portion of most Built Environment degree programmes and CPD events dealing with legal topics are amongst the most popular. Unfortunately these activities are not matched by an equivalent output of new law-related research from the Built Environment research community.
In consequence, areas of law directly impacting on the work of the property and construction professions can often remain undeveloped and difficult to interpret. The lack of academic support also prevents these professions from effectively influencing the ongoing development of the law, with consequences for all those involved in the property and construction sectors.
As a contribution to law-related research in the Built Environment a special issue of Structural Survey will therefore be dedicated entirely to the law subject area. Scholarly papers are invited which address this broad theme, including, but not limited to:

The Law relating to Construction Contracts and Procurement Conflict Management, ADR, Litigation and the Expert Witness
- •
Negligence, Professional Liability and Indemnity
- •
The Law of Real Property, the Land-Related Torts and Neighbourly Matters
- •
Landlord and Tenant Law, including Dilapidations, Rent Review and Housing Law
- •
Building Control, Planning, Conservation and Environmental Law
- •
European Law, including Employment and Health and Safety Law
- •
The Role of Legal Scholarship in the Built Environment
The special issue will be published in early 2007 (before the deadline for the United Kingdom's 2008 Research Assessment Exercise). All papers will be subject to peer review and should be submitted to the journal's legal editor by 2 October 2006.
