Following a recent decision by the Court of Appeal, the Health and Safety Commission is consulting on an amendment to the CDM Regulations which will ensure that designers are responsible for the work of others, including their employees. The Court of Appeal judgment in the case of Paul Wurth SA of Luxembourg was that the current wording of the regulations meant that no designer duty arose when a designer arranged for other persons, including his/her employees, to prepare designs.
