Abstract

Existing use rights are important to the surveyor as one of the bases of calculating compensation on compulsory acquisition. Additionally, they are a valuable negotiating tool when attempting to obtain planning permission and may, upon refusal, give a right to compensation themselves. The article looks at the details of the 8th Schedule of the 1981 Planning Act, how to interpret it and its use in practice. Confusion between the 8th Schedule and the General Development Order is addressed, and the recent Peaktop case is placed in context.
