Repossession postponed and forced sales
Abstract
Discusses the impact of the current economic climate on the private housing market and the increase in the number of mortgage repossession actions in respect of residential property since 1990. Considers the reported cases dealing with possession orders to assess the Courts′ response to the problems caused by unemployment on the one hand and falling house prices on the other. Concludes that the Courts may express sympathy with mortgagors but, at the end of the day, the question is whether or not the mortgagor is likely to pay off moneys due.
