Point of no return? Fair use on trial

Abstract

Purpose

This article seeks to discuss the implications of the Cambridge University Press et al. lawsuit filed against Georgia State University.

Design/methodology/approach

The article concerns itself with the root causes of the lawsuit, and the bizarre nature of producers suing a member of their primary clientele.

Findings

The article does not offer an opinion on which party should or will prevail, but instead focuses on the growing divide between publishers and academia, which seems headed for a showdown.

Originality/value

The article offers another perspective on the pending lawsuit, which has the potential to define fair use in a quantifiable way.
